To the maximum extent permitted by law, the total aggregate liability of LookMaxx for any claims arising out of or related to the Website shall not exceed the amount paid by the User, if any, to access the Website in the 12 months preceding the claim.

11. INDEMNIFICATION

The User agrees to fully indemnify, defend, and hold harmless LookMaxx, its affiliates, officers, directors, employees, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

The User shall cooperate fully in the defense of any claim and shall not settle any claim without LookMaxx’s prior written consent.

This obligation to indemnify applies regardless of whether LookMaxx was negligent, except to the extent such losses are caused solely by LookMaxx’s gross negligence or willful misconduct.

12. TERMINATION

12.1 Right to Terminate or Restrict Access

12.4 No Liability
LookMaxx shall not be liable to You or any third party for any termination, suspension, restriction, or modification of access to the Website or its features, including any loss of data, content, or functionality.

13. DISPUTE RESOLUTION

Any disputes shall first be attempted to be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996, failing which the courts in Kolkata shall have jurisdiction.
